This Privacy Policy explains how Better Buzz Coffee Company, LLC (“Better Buzz,” “we,” “us,” or “our”) collects, uses, and shares information provided to us when users visit our cafes or use our website, www.betterbuzzcoffee.com, and any other websites or applications associated with Better Buzz that refers users to or incorporates this Privacy Policy (collectively, the “Sites”).  

By visiting our Sites, you are agreeing to the terms of this Privacy Policy and our Terms and Conditions available at www.betterbuzzcoffee.com/pages/terms-conditions which are incorporated by this reference.  The Sites may contain content, services, advertising, and other materials that link to websites operated by third parties. We have no control over those other sites, and this Privacy Policy does not apply to them. Please refer to the privacy policies of such sites for more information on how the operators of those sites collect and use your personal information.

A. Personal Information.

We collect any personal information from you directly when you provide it to us and automatically as you navigate through the Sites. Examples of when you directly provide it to us include when you create an account, join our loyalty program, make a purchase on our website (including online ordering), participate in one of our surveys or promotions, submit a job application, or email us. The types of information we may collect includes your first and last name; password; email address; postal address; phone number; payment information, including credit or debit card numbers; and any other information you provide.   We may also use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns.

In this Privacy Policy, we collectively refer to such information as “Personal Information.” 

Like most websites, we use automatic data collection technology when you visit the Sites to record information that identifies your computer or device, to track your use of our Sites, and to collect certain basic information about you and your surfing habits. This information which we collectively refer to as “Usage Information” includes, but is not limited to: 

Purchasing Information.  

We may collect information about your transactions on the Sites, including what products you purchased and in what quantities, how frequently you purchased products, transaction amounts, payment information, shipping address, and order dates. 

Device Information. 

We may collect information about the computer or mobile device you used to access the Sites, including the type of computer or device, the operating system, your browser type, and your IP addresses. 

Browsing Information. 

We may collect information relating to your usage of the Sites, including referring and exit pages and URLs, keywords, date and time, the pages you viewed, the amount of time spent on particular pages, the items you placed in our carts, and similar information concerning your use of the Sites (the “Usage Information”).

We collect Usage Information by using cookies and pixel tags (also called web beacons or clear gifs). Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” information about your visit, which, in turn, helps us improve the quality of the services we provide on the Sites. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of website users. We do not collect Personal Information in this way, but if you’ve provided us with Personal Information, we may associate that information with the information that is collected automatically. Automatic data collection may be performed on our behalf by our services providers.

II. How We Use Your Information

We may use your Personal Information and Usage Information in a manner that is consistent with this Privacy Policy and the context of our relationship with you, including:

III. How We Disclose Personal Information to Third Parties

We do not disclose your Personal Information to third parties for their direct marketing purposes.  We may share your Personal Information under certain circumstances, however, including:

• With third-party service providers when disclosure is necessary for us to receive services including, but not limited to, email and postal delivery, order fulfillment, website hosting, and marketing and analytics.  We also share your payment information with third party service providers as necessary to process your payment for purchases.  Such third parties store your payment information; we do not store this information.  Storage by the third party service provider of your payment information is subject to such service provider’s privacy policies and practices. By providing your payment information, you acknowledge and agree to use of such information by the third party service provider for purposes of processing your payment to us.
• If we believe, in our discretion, that disclosure is required by law, to enforce our agreements or policies, or to protect the rights, property, or safety of Better Buzz or our customers.
• In connection with a potential or actual corporate transaction, such as a merger, consolidation, or sale of some or all of our business assets, or in the unlikely event of bankruptcy.
• At your direction or with your permission.
• As disclosed to you at the time of collection.
• As otherwise described in this Privacy Policy.

We may also share information that does not directly identify you, such as aggregate Usage Information.

IV. How We Protect Your Information

We take commercially reasonable steps to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from us may not be secure, and you should, therefore, take special care in deciding what information you send to us via e-mail.

V. Accessing and Modifying Account Information

You may access, update, or delete the information that is stored in your user account by visiting www.betterbuzzcoffee.com and signing into your account.  Please note that we may retain certain information for tax or record-keeping purposes as required by law or for legitimate business purposes.

VI. Your Choices

A. Promotional Communications.

We do not intend for our Site to be used by anyone under the age of 13.  If you are a User under the age of 13, please do not send any Personal Information to us.  If you are a parent or guardian and believe we may have collected information about your child, please contact us as described in the Contact section of this Privacy Policy.

We currently do not monitor, recognize, or respond to any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

This section applies only to individuals who are residents of California (“you” or “CA Consumers”), and it is intended to inform such residents about our data collection practices and your privacy-related rights under California law.

We do not sell personal information.  In the 12-month period prior to the date of this Privacy Policy, Better Buzz has not sold any personal information. 

We may share your Personal Information by disclosing it to a third party for a business purpose.  In the 12-month period prior to the date of this Privacy Policy, Better Buzz has disclosed Personal Information for a business purposes to the categories of third parties indicated in the chart above. 

C. Your Right to Access Information.

Up to two times each year, you or your authorized representative may request that we disclose to you the categories and specific pieces of personal information that we have collected relating to you during the 12-months before your request, our sources for collecting that information, how we used and shared that information, and our business or commercial purpose for collecting that information.  

You or your authorized representative may request that we delete personal information about you that we have collected.  Please note, however, that may not be able to fully address your request in certain circumstances, such as when retaining information is necessary to complete a transaction; to protect against fraudulent or illegal activity, or to prosecute those responsible for such activity; to exercise our rights; or to comply with a legal obligation.

We may require you or your authorized agent to provide additional information for verification purposes.

Better Buzz will not discriminate against you for exercising any rights under the CCPA.

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time-to-time and will post any changes on the Site as soon as they go into effect.  We will notify you by revising the effective date at the top of the updated Privacy Policy.  We may also provide you with additional notice by adding a notice to our homepage or sending you an email.

Please refer back to this Privacy Policy regularly to check for updates. By accessing the Sites after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes.
