Gift Card and Black Card Terms & Conditions

Your purchase or use of a gift card or Black Card constitutes your acceptance of the following terms and conditions (including an arbitration agreement). We reserve the right to change these terms and conditions without notice, from time to time at our sole discretion.
GENERAL TERMS:
Better Buzz Coffee Company (“Better Buzz,” “our,” “us,” “we”) gift cards and Black Cards (collectively, the “Cards”) are not subject to any service or dormancy fees or expiration dates.
The balance on Better Buzz gift cards and Black Cards may be applied towards eligible food, drinks, and merchandise at participating Better Buzz locations. Eligible goods are subject to change in our sole discretion at any time and without notice. Cards may not be used to purchase other Cards. Cards may not be used for purchases made on our website.
The dollar value on your Better Buzz gift card of Black Card is nonrefundable and may not be redeemed for cash unless required by law. In California, Cards with a stored cash value of less than $10.00 may be redeemed in cash for its cash value.
LOST, STOLEN, OR DAMAGED CARD POLICY:
You must safeguard your Cards from unauthorized use. We are not responsible if a Better Buzz gift card or Black Card is lost, stolen, or destroyed, or if the balance on your card is used without your permission. You are responsible for all transactions on your gift cards and Black Card, including unauthorized transactions. However, if your Better Buzz gift card or Black Card is lost, stolen, damaged, or used without your authorization, we may replace the card with the balance remaining on it at the time you contacted us, but only if you can provide us with proof of purchase and your 16-digit gift card number, or, in the case of a Black Card, you can provide proof that you are the registered owner of the card. If your gift card or Black Card has been lost, stolen, damaged, or used without your authorization, please call us at (619) 269-4022.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY:
BETTER BUZZ MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ITS GIFT CARDS OR BLACK CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
BETTER BUZZ SHALL HAVE NO LIABILITY FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN ANY WAY RELATING TO ITS GIFT CARDS OR BLACK CARDS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, IN THE EVENT A BETTER BUZZ GIFT CARD OR BLACK CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND BETTER BUZZ’S SOLE LIABILITY, WILL BE THE REPLACEMENT OF SUCH GIFT CARD OR BLACK CARD.
DISPUTE RESOLUTION:
Any controversy or claim arising out of or relating to these terms and conditions or of your purchase, use, or ownership of a Better Buzz gift card or Black Card, shall be resolved by binding, individual arbitration administered by the American Arbitration Association in accordance with its Consumer-Related Arbitration Rules, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. The place of Arbitration shall be San Diego, California. Notwithstanding the foregoing, you may assert claims in small claims if your claims qualify. The exclusive venue for such small claims will be the appropriate court located in San Diego, California.
We and you agree that any dispute resolution proceeding (whether in arbitration or court for any reason) will be conducted only on an individual basis and not in a class, consolidated, or representative action. Thus, you may not assert claims as a plaintiff or class member in any purported class or representative proceeding. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.
